Court Nullifies Election of Lamu West MP Stanley Muthama

The High Court on Wednesday nullified the election of Lamu West Member of Parliament (MP) Stanley Muthama.

During the final hearing, Justice Weldon Korir ruled the election of the Maendeleo Chap Chap MP was marred by irregularities.

Mr Muthama, had been declared the winner of the Parliamentary race by the Independent Electoral and Boundaries (IEBC) with 11,090 votes, against ODM's Rishad Amana who had 10,950.

The High Court Judge further ordered the IEBC and Returning Officer (RO) Abdalla Chikophe to pay the petitioner Sh3 Million.

Rishad Amana had moved to court to challenge the Lamu West MP election results on grounds that there were inconsistencies in the tallying of votes.

The Judge had previously ruled in his favor when he directed the recount of the Parliamentary seat votes.

During the vote recount, Muthama had expressed confidence that his win would be confirmed after the exercise.

“My win wasn’t accidental. It was a just election by the people of Lamu West. The vote recount doesn’t scare me. I call on my supporters to be patient and calm,” he stated.

The ODM politician had also claimed that his loss to Muthama was orchestrated by the military and other security personnel who liaised with IEBC.

Muthama's loss comes a day after a court nullified the election of Homabay Governor Cyprian Awiti.

Issuing the verdict, Justice Joseph Karanja ordered a fresh election citing irregularities in August 8 election.
