Court Blocks Siaya Governor Cornel Rasanga From Forming Cabinet

The High Court of Kisumu on Thursday issued a ruling barring Siaya Governor Cornel Rasanga from forming his cabinet.

Justice Tripsisa Cherere blocked the Governor's 10 nominees from taking the oath of office until the case is heard and determined.

"Pending the determination of the petition, the respondents are restrained from discussing or purporting to act on the subject matter before the court," Justice Cherere ordered.

Gov Rasanga and the Siaya county assembly Speaker George Okode have been sued by residents of the county on claims that the 10 nominees had been rejected.

The three residents who filed the suit - Brenda Achieng' Ongalo, Isaack Okinyi and James Anyiko - sought to have the Governor's list thrown out.

Justice Cherere set March 7 as the date for the inter parties hearing.

Nine of Governor Rasanga's county executive committee candidates were rejected by the county assembly on grounds that they had failed to meet Section 35B of the County Governments Act.

According to the section, the county boss is required to constitute his cabinet within 21 days of taking up the office. Rasanga took five months to forward his list of nominees.

Gem Member of Parliament (MP), Elisha Odhiambo, has in the past attacked the Members of County Assembly (MCAs) for rejecting the list stating that they were not as qualified as the Governor's nominees.

He further faulted the MCAs for "constantly rejecting the Cabinet for selfish reasons" and turning the exercise into "shenanigans play".
