Homa Bay Governor Cyprian Awiti Loses Seat

The High Court has nullified the election of Homa Bay County governor Cyprian Awiti.

The petition was filed by immediate former Kasipul MP Oyugi Magwanga through his lawyer Charles Kanjama.

Justice Joseph Karanja ordered a fresh election citing irregularities in August 8 election.

He stated that the election was not free and fair.

Magwanga, who became second after Awiti in the August 8 General Election, filed the petition with booklets of more than 15 pages at Homa Bay High Court in 2017.

In December, the High Court ordered a recount and scrutiny of votes for the governor race.

Justice Karanja had dismissed an application by Governor Awiti urging the court not to proceed with a recount.

The court granted an order to scrutinise and audit results on forms 37A, B and C, as well as KIEMS kits used by the electoral agency.

Elsewhere, Siaya County Governor Cornel Rasanga is also set to know his fate on February 26 in a peititon in which former Rarieda MP Nicholas Gumbo challenged his election.

Gumbo wants the court to nullify Rasanga’s win on grounds that he committed several irregularities.

In Migori, Justice Hillary Chemitei will rule on the case between Governor Okoth Obado and former Energy minister Ochillo Ayacko.

Kisii governor James Ongwae and his Nyamira counterpart John Nyagarama will also know their fates on February 27 and February 28, respectively.
