Judge Issues 9 Orders on Miguna Miguna's Return to Kenya

High Court Judge Chacha Mwita on Monday ruled on a matter concerning lawyer Miguna Miguna's deportation to Canada issuing nine strict orders to secure his return.

Following Justice Luka Kimaru's ruling that declared his deportation illegal, Justice Mwita granted conservatory orders that will see Immigration Department boss, Gordon Kihalangwa, issue Miguna with new travel documents to come back to Kenya and live as a citizen.

Judge Mwita maintained that the suspension of Miguna's passport was illegal and lifted the Immigration Department orders.

The judge also suspended Interior Cabinet Secretary Fred Matiangi's declaration revoking citizenship rights to Miguna and labelling him an enemy of the state until the case is determined.

Further, a gazette notice that declared National Resistance Movement (NRM) a criminal gang was revoked until Miguna's case is concluded by the court.

Justice Mwita ordered the Director of Immigration or in his absence, a senior official at the department, to facilitate travel arrangements for Miguna's return.

He directed the Immigration bosses to retrieve Miguna at a date and time that the fiery lawyer chooses.

Concerning his arrival in Kenya, the Judge ordered that Kenya National Human Rights Commission (KNHRC) Chairperson be given security clearance to monitor the conditions Miguna would be subjected to by the Government and to ensure his basic human rights ate not violated.

Judge Mwita urged the petitioners to fast-track the hearing of the case as the determination of the case was of urgency.

He added that Miguna and his fellow petitioners would cater for all the legal fees of the case.

Finally, the Judge directed that the respondents in the case be served via a notice published in the Standard or the Daily Nation.
