Court Orders Protection from Prosecution for Kakamega Tycoon Julius Mwale

The Director of Public Prosecution was on Wednesday ordered to keep away from Kakamega tycoon Julius Mwale.

Pleading with the court for the billionaire's protection, his lawyer Carlestous Shfwoka told the court that Mwale was on bed rest after suffering food poisoning.

High Court Judge Ruth Sitati ruled to have Mr Mwale protected from arrest and prosecution by the ODPP.

She further instructed the billionaire businessman to continue reporting to the Directorate of Criminal Investigations in Kisumu every Wednesday.

Mr Mwale, the proprietor of Mwale Medical and Technology City in Butere, is accused of having issued bad cheques to contractors, amounting to Sh22 Million.

In his defence, Mwale stated that his lawyers compelled him to write the cheques even after he had disputed the amount demanded by the contractors.

The controversial businessman is said to be behind a project to build a Sh200 Billion mall in the Western Kenya town.

The case was scheduled for March 8 and will be heard by Judge Jesse Njagi after Justice Sitati withdrew from the case for personal reasons.

Former Kakamega Senator Bonny Khalwale bashed the media for reporting Mr Mwale's court case accusing the journalists of intimidation.

"Whatever you want to call him, Julius Mwale has made a massive impact in our county. Any aggrieved creditor must follow due process & the media must stop tormenting him forthwith," Khalwale tweeted.
