Chris Kanan Loses Ugenya Parliamentary Seat

Ugenya Member of Parliament Chris Karan has lost his seat after the High Court ruled that the race was not free and fair.

Karan was also ordered to pay the petitioner, former area MP Dave Ochieng, Sh7 Million in costs.

Justice Tripsisa Cherere ruled that the campaign was "perverted" and the polls were not free and fair.

“I find that the campaign was perverted and compromised the integrity of the election,” the judge ruled.

The judge added: “Being Siaya was Raila Odinga’s backyard, linking Ochieng to Jubilee affected the final results. These results did not pass the transparent and verifiable-election test.”

Ochieng' told the court that his campaign was frustrated after he was accused of having a hand in the killing of former IEBC ICT Manager Chris Msando.

In the petition filed by his lawyers Rogers Sagana and Daniel Achach, Ochieng cited electoral malpractices which he noted affected the outcome of the elections.

“Having scrutinised the entire electoral process, we have established that a lot of malpractices happened," Sagana noted.

"Our client is convinced that the outcome does not reflect the will of the Ugenya voters. We hope that the court will approve our concerns,” he added.

Sagana argued that they had enlisted the IEBC returning officer in the suit and hoped the court would nullify the elections.
