Kirinyaga Governor Anne Waiguru at Supreme Court After Court of Appeal Ruling

Kirinyaga Governor Anne Waiguru on Friday filed a notice of appeal at the Supreme Court following a Court of Appeal ruling that revived a petition challenging her election in August 2017.

Through her lawyers, the notice was filed just moments after the three-judge bench at the Appellate court handed victory to former Gichugu Member of Parliament Martha Karua.

To protect her governorship, Waiguru asked the highest court in the land to overturn the Court of Appeal ruling and uphold the August 2017 Kirinyaga election results.

"Take notice that being dissatisfied by the Court of Appeal ruling intends to appeal at the Supreme Court against the whole of the decision," the notice read in part.

The Appellate court set aside the ruling made by the Kerugoya High Court instructing the lower court to hear the election petition afresh.

Speaking after the ruling, the Narc-Kenya party leader's lawyer explained that Justices Mohammed Warsame, Daniel Musinga and William Ouko had set a precedent that should be followed.

"We are happy that the court has set the record straight on the judicial malpractice that happened in Kerugoya where the court decided on the petition without a hearing.

"The court has also set the record straight on costs. The court noted that there has been a trend these last few weeks of courts giving prohibitively high costs. The costs should never be seen as a deterrent to justice," lawyer Gitobu Imanyara stated.

He added that Karua's team was ready to get back to court on March 5 as ordered.

According to the rules of the Supreme Court, Waiguru's notice of appeal will receive an address within 14 days.
