AG Paul Kihara to Challenge Fred Matiang'i's Conviction

Attorney General Paul Kihara on Wednesday evening revealed that the government will challenge the conviction of Interior CS Fred Matiang'i, Immigration Principal Secretary Gordon Kihalangwa, and National Police Service Inspector General Joseph Boinnet.

The AG maintained that Justice George Odunga's findings were faulty as the three state officers had not violated court orders deliberately.

According to Capital FM News, Kihara argued that they were fully committed to protecting and enforcing the rule of law thus would not disobey court orders on purpose.

On Thursday morning, the three failed to appear in court for the second time and State lawyer Charles Mutinda admitted he had not spoken to his clients.

This enraged Miguna Miguna's lawyer Cliff Ombeta who stated that Mutinda was lying and there was no way he would produce Matiang'i in court even if given an extra hour.

Matiangi, Kihalangwa, Boinnet, as well as Directorate of Criminal Investigations boss George Kinoti, Flying Squad Boss Said Kiprotich, and the officer in charge of the Jomo Kenyatta International Airport (JKIA) were convicted by Justice Odunga after failing to honour his summons and produce Miguna in court on Wednesday.

Despite the orders, the Canadian-based advocate was deported for the second time after he was forced to board a Dubai-bound flight on Wednesday night.

Reports indicate that the plane carrying him touched down at the Dubai airport at around 5 am on Thursday morning.

Otiende Amollo, a member of Miguna’s legal team, disclosed that the vocal activist was flown out of the country on Emirates flight EK 722.

Breaking the news, the Rarieda Member of Parliament (MP) stated: “So they have assaulted lawyers, defied the Court and deported Dr Miguna.

“I feel helpless and angry as an advocate! Useless as an MP and angry as a Kenyan!” The renowned lawyer tweeted summing up his experience following the standoff that saw Miguna spend over 72 hours at the JKIA."
