Babu Owino Awaits Court Ruling on Nullification of His Election

Embakasi East MP Babu Owino will today (Friday) know the fate of his appeal following the nullification of his election.

The Legislator took to social media to rally his supporters to show up in large numbers as the crucial ruling is made.

"I urge all my supporters to show up in solidarity with our course at the said court from 8:30 am tomorrow.

"This is our battle as patriots against agents of impunity who are out to deny Embakasi East residents an opportunity to have the best representation in the parliament.

"I pledge to fight for my people to the end. God bless Embakasi East," he wrote.

Babu’s August election was nullified in a ruling by Justice Joseph Kiplagat Sergon who cited widespread errors and irregularities.

The petitioner, Jubilee Party's Francis Mureithi, had accused the MP of electoral malpractice.

In April, Babu moved to the Court of Appeal to appeal the nullification of his election by the High Court.

Through an application filed by his lawyer, Jackson Awele, the MP sought to have the decision to nullify his election reversed with an order dismissing the polls petition. 

"We pray that the Court be pleased to declare that the Owino Paul Ongili Babu was duly elected as the Member of the National Assembly, Embakasi East Constituency in accordance with the Constitution and the Elections Act,” Awele stated in the court papers.

At the time, lawyer Ahmednasir Abdullahi explained that there was hope for the MP since judgments upholding or quashing petitions had moved to the Court of Appeal and outcomes would change.

"...a robust appeal process and courts presided over by three judges will now be the new battleground.

"I'm sure that a few judgments will be overturned and many upheld," stated Ahmednasir on Twitter.

His sentiments were echoed by lawyer Donald Kipkorir who hinted that the basis of Babu's nullification did not hold water.
