DPP Haji Orders Release of 2 Murder Suspects

The Director of Pubic Prosecution (DPP) Noordin Haji has ordered the release of two suspects arrested in connection with the murder of former Kakamega DC Paul Yatich's wife.

According to The Star, the two will instead be witnesses against the prime suspect Boniface Kiptoo who was arrested in Nakuru town.

Laban Cheruiyot and Simon Lumile were arrested in Nandi while in possession of a vehicle belonging to the deceased Loise Yatich.

Following DPP Haji's directive,  Chief Magistrate Charles Obulutsa ordered police to release the two.

In his application, the DPP indicated that the investigations had revealed that Cheruiyot and Lumile were not involved in the killing.

Consequently, DPP Haji further directed the police to record statements from them as prosecution witnesses.

The two have been held in custody for 14 days before being presented to court.

"I direct that the two be released and the charges against them are withdrawn," Justice Obulutsa stated.

The Judge indicated that the court has considered DPP’s letter which indicates that the suspects will now be state witnesses.

Loise was as a curriculum development officer with the Teachers Service Commission in Uasin Gishu County.

Separately, a court in Eldoret on Tuesday began hearing the dispute over the burial of Loise's body.
