Lawyers on the NYS case have filed a petition asking the court to prevent Daily Nation newspaper from covering its proceedings.
According to the petition, the lawyers claimed that the paper had an interest in the case.
The lawyers also want the publication banned since they have been painting their clients in the wrong light according to a report by The Star.
The Chief Magistrate on the case Douglas Ogoti, in a ruling on Thursday, adjourned the trial after the lawyers complained that he had overlooked the rights of the accused in an earlier ruling.
The Chief Magistrate is set to give his ruling over the Daily Nation petition on Friday, November 2 and summoned two journalists from the media house to appear in court.
More than 38 suspects, including former Public Service PS Lillian Omollo, are facing the trial with the fast batch accused of a loss of Ksh225 million at the service.
The Directorate of Public Prosecutions (DPP) introduced new evidence to the court against the suspects on the case.
The DPP has, so far, netted 54 suspects over the loss of Ksh468 million at the service and has advised the court to charge them with abuse of office, breach of trust, fraudulently making payments among others.
All the suspects, however, pleaded not guilty to all the charges against them.
Interior Cabinet Secretary Fred Matiangi recently announced that the government will no longer allow cash transactions for NYS tenders opting for the traceable receipt system.
