How the Gender Bill May See Uhuru Become Prime Minister - Mutahi Ngunyi

Political analyst Mutahi Ngunyi on Sunday opined that the much debated Gender Bill may see President Uhuru Kenyatta become the Prime Minister.

According to Mutahi, failure to pass the Gender Bill as required by the Constitution may see the president dissolve parliament.

In his view, dissolving the parliament will provide an opportune moment to carry out the referendum alongside the elections.

"If parliament is dissolved, a by-election for the 300 MPS must be held. This election will be held at the same time as the referendum to save on costs," Mutahi noted.

"Uhuru and Raila will use this window to do a referendum that makes Raila the ceremonial President and Uhuru the Executive Prime Minister.

Alleging to what could turn out to be a complex scheme to change the governance structure by 2021, the political analyst noted that Kisumu Governor Anyang' Nyongo has previously indicated that Uhuru will not be going anywhere after 2022.

"If this happens, there will be no 2022. But because Kenyans are very slow, they will only understand the scheme after it has happened.

Quoting Article 261 (7) Kenya Constitution, Mutahi noted that the Gender Bill provides sufficient ground to terminate the legislators' tenure after passing 47 out 48 mandatory legislation as required by the law.

"If Parliament fails to enact legislation in accordance with an order under clause (6) (b), the Chief Justice shall advise the President to dissolve Parliament and the President shall dissolve Parliament", Article 261 (7) stipulates.

"It will start with the Gender Bill and end up with Raila as the Ceremonial President and Uhuru as the Executive Prime Minister," Mutahi concluded.

The Constitution gave the parliament a three years' deadline to enact the County assembly gender balance and diversity bill as outlined in Article 197.
