93-Year-Old Grandma Who Walked 19km in Pursuit of Justice

A grandma aged 93 on Wednesday narrated how she has been walking from Githurai to Milimani law courts in Upperhill, a distance estimated to 19km, in search of justice for her grabbed land.

Njeri Kiriba filed a case against Kenya Ihenya company seeking to restrain them from trespassing her property.

Although the mother of two and a widow has had no lawyers to represent her case, she has been getting to Upperhill at 5pm and staying in the cold till morning for three years whenever a mention or hearing is scheduled.

“I do not have an advocate, my advocate is God,” the grandma remarked.

The woman noted how the company sold her two plots and issued her shares certificate but denied ballot papers despite paying in full.

According to The star, Njeri said she does not trust her children to follow up on the case as they plan to take her belongings.

“My son who used to take care of me passed away and the other two children do not care about me,” she claimed.

According to the company, a meeting held in 1985 cited that for each member to be given a plot, they needed to pay Ksh3,500. However, Njeri was unable to pay the amount in full and was allowed to pay in installments, which she did. The company maintains that the receipts belong to plot 145 only, not plot 144.

“Apart from filing the defense, the defendant did not adduce any evidence in court,” the company said in its suit papers.

However, High Court Judge Kossy Bor in November, 2017 ruled in favor of Njeri. He directed she be given both plots. He also told the company to give transfer documents that will facilitate registration of the land within 21 days indicating Njeri as the owner of the property.

“The defendant or any other person claiming under them is restrained from further harassing the plaintiff on plot number 144,” the judge ruled.

Njeri is yet to get the fully signed papers and she was waiting in court on Wednesday.
