Ex-Ruaraka OCS Nahashon Mutua Sentenced to Death

Former Ruaraka OCS was, on Thursday, sentenced to death after he was charged with killing a trader in the station's police cells back in 2013.

Delivering her ruling, Justice Stella Mutuku stated that the prosecution had proved its case beyond reasonable doubt.

“The Prosecution has proved beyond reasonable doubt that the police caused the deceased suffering while in cells which caused his death,” ruled the Judge.

The officer had been accused of torturing a suspect, Martin Koome, to death at the Ruaraka police cells.

In December 2018, the judge convicted the former police boss ruling that the evidence that was presented at the time was compelling enough to convict him.

"Evidence shows he tortured and killed Martin Koome in a cell five years ago," stated the judge at the time.

In the incidence that took place on the night of December 19, 2013, Koome succumbed to injuries sustained after being beaten by the officer at Ruaraka Police Station.

Police took him to Kenyatta National Hospital with a swollen face, deep cuts, and his wife could barely recognise him.

However, soon after the incident, the former Ruaraka commander was transferred to Machakos County to fill the position of staffing officer.

Another suspect, Kevin Odhiambo, had been arrested and charged with murder but the case was terminated after the Independent Policing Oversight Authority (IPOA) investigated the matter and found Mr Mutua culpable.

IPOA had told the court then that Mutua had interfered with the investigations by intimidating and coercing witnesses who had recorded statements with the oversight authority.
