Court Rebukes Lawyer Nelson Havi for Attacking DPP Noordin Haji

The court has rebuked Senior counsel Nelson Havi for attacking the Director of Public Prosecutions (DPP) Noordin Haji on social media.

The lawyer had accused the DPP of paying bloggers to spread false information about the Deputy Chief Justice, Philomena Mwilu.

The 5-judge bench rebuked his actions, citing the senior counsel should have respect for the legal profession.

"It is important for Counsel to conduct themselves with decorum and respect for the legal profession while expressing themselves on social media," Justice Hellen Omondi stated.

Havi is among the 18 lawyers, who have been appointed to represent DCJ Mwilu in a case where she is accused of failing to pay stamp duty and abuse of office.

However, the office of the DPP, told the court that they acted purely on evidence and followed the law in pressing charges against the DCJ.

On Wednesday, Oueen's council Khawar Qureshi stated that they have a strong case against DCJ Mwilu.

“We have evidence to sustain criminal charges against DCJ Mwilu,” stated Qureshi.

The court heard that the DPP followed the law in pressing charges against the DCJ on abuse of office.

The prosecution dismissed claims that the charges had an ulterior motive.
