Elijah Kibet Kemboi, on March 25, took two senior State officers to court for allegedly detaining his wife, Mercy Mweru Kurii, at the Lanet Military Academy.
Kemboi sued the Principal Secretary in the Ministry of Defence Saitoti Torome and the Attorney General Paul Kihara over the detention.
Mweru’s lawyer, Mongare Gekong’a, filed the matter under certificate of urgency claiming that Mweru has been in custody for many days without any justification from the government.
“I have made numerous attempts to visit her, but they will not allow me to. Police have not arraigned her in court to charge her officially,” revealed Kemboi.
Nakuru high Court Judge Joel Ngugi gave the Ministry of Defence until April 2 to explain why the woman was in their custody.
This is after the ministry officials asked for more time to come up with a comprehensive report on why Mercy Mweru, a soldier at the facility, was detained.
The Kenya Defense Forces (KDF) is expected to explain in court why they are detaining the female soldier at the Nakuru based military academy.
Kemboi wants the High Court to order the unconditional release of his wife who was arrested under unclear circumstances and yet to be arraigned 57 days later, the Daily Nation reported.
According to Kemboi, Mweru, who has not been in touch with her 5-year-old daughter, has suffered for long in custody.
It is also alleged that the commanding officer at the Kenya Military Academy Lanet was served with a demand letter for the release of Mweru but the Ministry is yet to take any action on the matter.
