Court Orders Kabogo to Pay Ksh100 Million Fine

The court has now declared that former Kiambu Governor William Kabogo and two others are personally liable for the recovery of a fine imposed on a company associated with him.

Kabogo, alongside Esther Gitau and Patrick Kamau, who are directors of Acres and Holmes Limited will now be required to pay the Ksh100 million fine slapped on Caroget investment limited as reported by People Daily.

Aster Holdings had won a Ksh3.5 billion land dispute case in which Caroget also claimed ownership.

Justice Elijah Obaga of the Environment and Land Court had earlier declared the 7.5 acre land in Westlands that had led to a ten-year court battle between Aster Holdings owned by Nayan Patel and Caroget Investments fully registered and owned by Aster Holdings.

Caroget Investments was allegedly owned by Kabogo.

The Justice went ahead to impose a Ksh100 million fine on the firm, liability which has now been transferred to the former Kiambu governor and his two associates.

This is after Aster holdings went back to court claiming they could not trace the physical address of Caroget investments or any of its assets for the judgment to be executed.

In its application, Aster Holdings wanted Kabogo and the other directors to pay the fine by lifting the corporate cover of the firm.

The fine was imposed after the court found the Kabogo-linked company liable for illegal possession and trespassing.

Justice Obaga also noted that Kabogo had lied under oath when he declared that he was a director at Caroget Investment.
