Court Lets Man Accused of Stealing Ksh20M Holiday in South Africa

A suspect, Wycliffe Simiyu Koyabe, at the center of a Ksh20 million theft case is free to fly to South Africa to enjoy a holiday thanks to the ruling of a Nairobi court.

While dismissing three applications by the businessman, Makadara Court Principal Magistrate Meresia Opondo allowed him to travel to the Southern Africa nation and be with his family before the holiday ends.

In the ruling, the magistrate further allowed the businessman to access his passport when he needed to travel but barred him from having unlimited access to it.

He is expected to bring back the passport on May 9 when the case will be mentioned again.

Koyabe was charged with stealing the money by agent which is against the Kenyan laws.

The court heard that the businessman stole the man which he was supposed to remit to the company for the purchase and delivery of a bulldozer. He was its agent at the time.

The magistrate further turned down a request by the accused who wanted the complainant to be recalled to testify.

Opondo explained that the case had dragged on for too long and that the witness testified with both parties indicating satisfaction at the time.

This comes just days after former ICT principal secretary Sammy Itemere, who is facing a suit in connection with the theft of Ksh122 million state funds, got his passport back.

He received the document in order to enable him to travel to Hamburg, Germany, to attend a rotary meeting.
