Kidero Suffers Huge Blow at High Court as Hearing Date is Set

Former Nairobi Governor, Dr Evans Kidero, was dealt a huge blow at the high court on Tuesday following his appeal against the graft charges laid against him.  

Nairobi governor and eight others stood accused of conspiring to commit fraud leading to the loss of Ksh213,327,300 at the county government between January 16, 2014, and January 25, 2016.

Judge John Onyiego, speaking at the court, dismissed the former governor's application to stay the entire matter pending the determination of his appeal.

"There is no express provision for stay of proceedings in the subordinate court under the Criminal Procedure Code (CPC) pending an appeal," judge Onyiego ruled.

Kidero, through his senior counsel and Siaya Senator, James Orengo, had tried to poke holes in the prosecution's case by stating that the charges laid against him were too vague and were only meant to embarrass him.

The former governor thus sought to have the case dismissed and made an appeal at the high court after Magistrate Douglas Ogoti rejected his plea to be tried separately, as well as his application against the charges, which he claimed were faulty.

Judge Onyiego agreed with the magistrate's ruling that the allegations satisfied the threshold of law in criminal pleadings.

Kidero, through his lawyer, requested that the court facilitates the hearing of their appeal before May 20, 2019, following the ruling.

The court obliged with judge Onyiego stating that May 14, 2019, would be convenient for all parties.

Other suspects in the case include former employees Jimmy Mutuku Kiamba (Chief Finance Officer), Luke Mugo (acting CFO), Lilian Ndegwa (County Secretary), Gregory Mwakanongo (Finance and Planning minister), Luke Mugo (acting CFO),Stephen Ogago Osiro (head of accounting) and Maurice Ochieng Okere (acting head of Treasury).
