CJ Maraga Orders Dismissal of 3 Judges

Three Judges have been forwarded to President Uhuru Kenyatta for dismissal following an announcement by Chief Justice (CJ) David Maraga on Thursday.

The Judicial Service Commission (JSC) following extensive deliberations, forwarded Justice Martin Mati Muya, Justice D.K. Njagi Marete, and Lady Justice Lucy Waithaka for dismissal.

CJ Maraga during his presser revealed that the commission was in agreement that the petitions submitted against the three satisfied the threshold needed to warrant immediate dismissal.

JSC pointed out that judges had been served with charges on various acts of misconduct.

“The Petition against Lady Justice Lucy Waithaka was filed by Philip Kipyegon Lelei in Kericho H.C.C.C No. 64/2008, Jonathan Kimutai Mibei Vs Philip Kipyegon Lelei,” the JSC revealed.

She was reportedly probed after it was realized that she had issued two conflicting judgements over the same matter, thus explaining Mr Kipyegon's accusation of impropriety on the judge's part.

Justice Muya, on the other hand, faced accusations of abuse of office, bias, incompetence and gross misconduct over how he handled a case file against NIC bank by two petitioners.

The third judge, Justice Marete on his part was accused of gross misconduct, bias, impartiality and breach of constitution in the case filed by Kenya Tea Growers Association (KTGA), Siret, Unilever and five other at the Kericho Employment & Labour Relations Court.

“After hearing the following 3 petitions, the Commission was satisfied that they disclosed grounds for removal under

Article 168 (1) of the Constitution and made a decision to Petition H.E. the President for the appointment of

Tribunals under Article 168 (5) of the Constitution,” JSC stated.

JSC thus moved to ask Uhuru to expedite the process of forming a tribunal to investigate the conduct of three judges as the charges laid against them warranted removal.
