Devolution Cabinet Secretary Eugene Wamalwa has been taken to court over a house purchase deal, Nation reports.
The petitioner, former nominated Senator Catherine Nabwala Mukite wants the court to compel him to pay Ksh27.1 million after committing to purchase a house that she owns with her ex-husband.
The couple entered into an agreement with Wamalwa in October 2015. However, she claims the deal has not been finalized four years down the line.
Mukite revealed that the CS signed a nine-page document promising to pay Ksh90 million by December 25, 2015.
However, she claims that Wamalwa has not honoured his end of the deal. In her suit, Mukite stated that he has paid only 70 per cent of the money and was reluctant to pay the balance.
Mukite wants the court to direct the CS to furnish the requisite security before she takes part in an arbitration that he had requested.
The former Senator and her husband, former Kimilili MP Suleiman Murunga are no longer together and this has complicated the case.
Mukite has also accused Wamalwa of striking secret deals with her ex-husband.
Court files indicate that Murunga and Mukite were to divide the money that was paid by Wamalwa equally. However, the latter claims that the former MP received more money.
The sale agreement, which is part of the court proceedings, states that Wamalwa was to pay a Ksh18 million deposit. He paid the amount and it was divided equally between Murunga and Mukite.
Wamalwa also paid Ksh27.1 million to free a title that had been held as security.
Nation reported that he has also been remitting amounts from as low as Ksh90,000 to Ksh4 million. By August 2018, the CS had paid Ksh64.8 million separately to Murunga and Mukite.
The remaining amount, Ksh27.1 million, is the bone of contention.
