MPs Strike Back After Being Denied Ksh250K Allowance

Lawmakers have picked a fight with the Salaries and Remuneration Commission (SRC) after the agency obtained orders to stop each of them from receiving a Ksh250,000 monthly house allowance.

A report by Sunday Nation indicated that MPs have declined to approve SRC's budget for new office space, travel and consultancy services.

According to the publication, Parliament, through the Finance and Planning Committee, is also planning to take the agency to court for misappropriating funds.

The committee, which is chaired by Kipkelion East MP Limo Kirui claims that SRC spent Ksh99 million that had been allocated to it to buy top-of-the-range vehicles for its commissioners.

This development comes barely three days after the SRC obtained orders stopping the Parliamentary Service Commission (PSC) from paying MPs the disputable house allowances until the case is heard and determined.

SRC also sought to recover money that had already been paid to the legislators arguing that it was unconstitutional and illegal. 

"The decision of the PSC to set and pay MPs a house allowance is antithetical to the rule of law. In addition, it contradicts the express and clear constitutional provisions in Article 230(4) (a) that empower the SRC to set and review the remuneration and benefits of state officers.

"Moreover, the decision violates the provisions of Chapter Six of the Constitution on Leadership and Integrity,” SRC sated in its petition. 

Through their lawyer Peter Wanyama, the SRC has sued the PSC, clerks of both Houses and members of the PSC including speaker Justin Muturi.
