Nairobi Woman Representative Esther Passaris is engaged in a multi-million court battle with a billionaire's widow over her home in Kitisuru, Nairobi County.
Reports indicated that the widow to the late billionaire Kultar Singh Hanspal accused Passaris of forcefully taking the property that she has reportedly lived on for the last 13 years.
The widow, Alka Roshanlal Hanspal, in court papers, further argued that she sold the house that stands on a two-and-a-half-acre to another person identified as Charles Kanyuga Maina and his wife Grace Wanjiku Kanyuga.
The case, which commenced in 2014, was slated for hearing on July 22 this year but the legislator requested for a new date in line with her busy schedule.
Passaris, in her defence, argued that she rented the property in 2006 from Kultar and later acquired it in 2009 by making a purchase valued at Ksh35 million.
The report further detailed that in the tenancy agreement lease was a clause that allowed Passaris to purchase the property.
The lease agreement was reportedly signed between Passaris and Alka but was later revoked when Kultar recovered on grounds that his wife had no legal capacity to sign it.
Alka, in her suit, explained that she was under pressure when she signed the agreement since her husband was ill and her family was experiencing financial problems.
She claimed that Passaris did not pay for the house and that she took advantage of her when her husband was ill.
“Kultar Singh entered into a tenancy agreement with the plaintiff (Passaris) commencing October 1, 2007, for two years, by which the plaintiff was in possession of the suit property as tenant of which she has been paying rent to the third defendant (Alka) but not as a purchaser.
“Passaris took advantage of the situation I was facing,” read part of the court documents.
