Deputy President William Ruto through his lawyer Ahmednasir Abdullahi wants Siaya Senator James Orengo and Rarieda MP Otiende Amollo thrown out of the Weston Hotel land case.
The two legislators are representing Kenya Civil Aviation Authority (KCAA) which wants to repossess the land that was declared to be public by the National Land Commission.
Abdullahi argued that Orengo and Amollo are Members of Parliament and should not be allowed to prosecute cases in court.
He also took a swipe at the duo, accusing them of acting “out of ulterior motives and to attract media mileage”.
“I will be filing an application seeking to have the applicant’s lawyers withdraw from the case. The issue to be determined will be whether members of an arm of government can represent parties," spoke Ahmednasir.
"He is a leader of the minority and is expressly prohibited by the constitution,” he added.
Orengo dismissed Ahmednasir's argument explaining that past efforts to have him kicked off cases had failed.
“As to the application my learned friend wants to file, many have been filed against me without success,” he stated.
After the NLC declared that the DP's hotel was built on public land earlier in the year, Ruto acknowledged that he had bought the parcel from a person who may have acquired it illegally.
KCAA then sought to repossess the land and demolish the hotel because it is on a flight path and poses a risk to aircraft operating at Wilson Airport.
