Charles Mwenda who was forced to spend a rainy night under a lorry with the body of his wife has moved to sue the state.
Mwenda has moved to court on grounds of being mistreated by the police and being denied the chance to accord his deceased wife a decent burial.
The suit will be filed at the Meru Law Courts through lawyer Vivian Wambulwa after the incident elicited fury over the neglect Mwenda faced.
Speaking to Kenyans.co.ke, Meru County Police Commander Patrick Lumumba, however, denied knowledge of the suit filed against the government.
"I'm not aware, we ask for more time on the investigation, we have resumed office today, let me find out what will be going on but the suit is news to me, I'm not aware," noted Lumumba.
Charles Mwenda is also seeking to have his two children brought home so as to have a moment to mourn their late mum.
Mwenda has since been placed under 14-day mandatory quarantine to determine whether he may have contracted the virus during his travel.
Meru County Commissioner, Allan Machari is set to issue a statement on the investigation of the matter which sparked outrage from the public.
There have been questions in the case including the burial permit signed by Maldini Sub-County Police Commander Simon Muli who provided clearance for 33 persons to travel for the send-off while the government permitted only a maximum 15 people.
The family, relatives and friends traversed about 10 counties before being stopped about 40 kilometers from their destination.
Another bone of contention is why 15 of 33 people who had traveled not allowed to proceed for the burial as per the government directives.
Three cases of Covid-19 were confirmed in Meru after a driver who had travelled from Mombasa tested positive on Wednesday May 27.
