UPDATE Tuesday, June 9: Matopeni MCA Abdi Guyo obtained court orders stopping conduct into his activities after he was accused of misconduct.

He was accused of violating Standing Order 242 of the County Assembly hence risking the loss of his elective seat.

He was suspended by the assembly after skipping 11 sittings contrary to section 192 of the Constitution of Kenya.

According to the assembly's committee seen by Kenyans.co.ke on Tuesday, June 9, Guyo was kicked to the curve after missing 11 consecutive sittings.

"Upon review of documentary evidence and examination of witnesses, the select committee on powers made the following observation:

"That Hon Abdi Hassan, by failing to attend 11 sittings, without any justifiable reason, he is in breach of Standing Order 242 and Article 194 (1) (b) of the Constitution whose consequence is the declaration of a vacancy in the seat of the Member for Matopeni Spring Valley Ward," read the document in part.

The reason for his absenteeism was not immediately established since his phone was off at the time of publication. He is expected to stay away for a year.

Guyo has, in the recent past, survived narrowly from being impeached as the majority leader following wrangles with Nairobi Governor Mike Sonko with his conduct put into scrutiny.

On October 4, the governor wrote to Nairobi County Assembly Speaker Beatrice Elachi and Jubilee Party Secretary-General Raphael Tuju, nominating another MCA to replace Guyo as a majority leader.

Guyo, who serves as Spring Valley Matopeni Ward MCA, was temporarily replaced by Dandora area III MCA Charles Thuo Wakarindi as the majority leader before he was reinstated in May 2020.

The constitution provides, "The office of a member of a county assembly becomes vacant if the member is absent from eight sittings of the assembly without permission, in writing, of the speaker of the assembly, and is unable to offer satisfactory explanation for the absence."

Other reasons include if a member dies, removed from office or resigns in writing addressed to the speaker of the assembly.

This comes after Nominated MCA Habiba Hussein lost her seat after missing seatings for two years.

The nominated MCA had undergone a difficult and complicated pregnancy for the better part of 2018.
