The Ministry of Lands and Physical Planning has issued a notice on how Nairobi Residents could embark on collecting their title deeds and leases.
In a notice dated Sunday, March 7, Lands Cabinet Secretary Farida Karoney affirmed that the title deeds collection exercise would resume at the Embakasi Ranching Company office grounds in Ruai on Monday, March 15, 2021.
According to the ministry, the exercise had been halted initially following disputes that had arose from plot owners hence the Ministry needed time to make the necessary corrections.
The exercise will run concurrently for two weeks till Friday, March 26.
Procedure
1. All individuals are to present themselves at the Embakasi Ranching Company offices between Monday, March 15 - March 26 between 9 am to 3 pm.
2. Documents required for the signing of leases are as follows:
For Individuals:
Three color passport photos, original and copy of National ID, copies of the Share certificate (front and back) and a copy of Kenya Revenue Authority (KRA) PIN Certificate.
For Companies
Copy of certificate of registration, a copy of KRA PIN Certificate, copies of KRA Pin and National ID for directors and three-color passport photos for each director.
For Self Help Groups
Certificate of registration, copies of KRA PIN and National ID trustee
3. The documents required for the collection of title deeds are as follows:
For Individuals:
Original and copy of National ID, copies of the Share Certificate (front and back)
For Companies:
Copy of certificate of registration, a certified copy of CR12, copies of National ID for directors and the letter of authority to collect the title or titles
For Self Help Groups
Certificate of National ID Copies of trustees and the letter of authority to collect the title or titles.
According to the ministry, all plot owners are required to adhere to Covid-19 guidelines issued by the Ministry of Health in order to be served.
Further, only a limited number of plot owners would be served on a daily basis in order to avoid a large gathering.
The Ministry also warned plot owners against presenting fake documents, noting that the offence would lead to arrest and prosecution.
Karoney noted that any plot with a dispute would not be titled until the matter is resolved. The news comes as the lands ministry had announced the transition to a new lands registration system.
This meant that all titles issued under the repealed laws would be cancelled and replaced with titles under the Land Registration Act, 2012.
Karoney, in a past statement, noted that the Act would solve the confusion occasioned by the different laws that had resulted in fraud, delays in service delivery, centralisation of land services and threats to the right to property.
“The ministry has thus embarked on a process of conversion of all parcels from the ambit of the repealed statutes with a view to migrating to the purview of the Land Registration Act 2012,” Karoney stated.
