Former presidential candidate Ekuru Aukot and his wife are on the spot for allegedly defrauding Thirdway Alliance Executive Director Kamau Andrew Njoroge a motor vehicle valued at Sh 600,000.
Through his lawyer Edwin Saluny, Njoroge wrote a letter to the Director of Public Prosecutions Noordin Haji requesting him to institute criminal charges against Aukot.
He alleged that Aukot had obtained money by falsely pretending he would sell him a motor vehicle registration number KBL *02B.
Lawyer Saluny indicated that Njoroge had received summons by DCI Kabete police station over theft allegations in respect to the motor vehicle in question.
Njoroge allegedly honoured the summons and visited the Kabete DCIO offices where the vehicle was impounded in the guise of conducting further investigations.
"To our clients utter shock and dismay, on or about November 8, 2020, he learnt through the investigating officer in the matter that the vehicle, which he had lawfully purchased from Dr Ekuru Aukot for value had been released to Ekuru without any colour of right," reads a section of the letter from Lawyer Saluny seen by People Daily.
Following the revelation, Njoroge later made a report at Muthagari police station saying that Aukot had reportedly refused to transfer or facilitate the transfer. He added that Aukot had colluded with officers at Kabete police station to defraud him of both his money and the car.
Lawyer Saluny stated that his client has made numerous visits at Muthaiga police station to follow-up on the matter, written a statement with police, provided all the required documents but his efforts to have action taken on Ekuru and the officers were futile.
"We write to request you to call for the file, take the necessary action to protect our client's rights which are being trampled upon. It is noteworthy to state that justice delayed is justice denied," stated lawyer Saluny.
The Third Alliance CEO had in November last year written to the DCIO Kabete police station seeking an explanation why they released the motor vehicle in question to Ekuru Aukot.
According to Njoroge, he had sought to have the DCIO order Ekuru to return the motor vehicle to Kabete police station in not more than two days of the receipt of the letter.
However, Njoroge says that the DCIO has never acted to his letter dated November 10, 2020.
Njoroge further alleges that two months before the car incident, Dr Ekuru Aukot had threatened to kill him a matter which was reported to Muthagari police station and issued with an Occurrence Book (OB) number 46/1/10/2020.
