Why MP Rigathi Gachagua Cannot Travel To Dubai

Mathira Member of Parliament Rigathi Gachagua is seeking to have his passport released by the anti-corruption court to enable him to travel to Dubai.

Through his lawyer Gibson Kimani, the MP told the court on Friday, August 27, he was scheduled to travel to the UAE on official business with other parliamentarians.

Gachagua told Milimani Senior Principal Magistrate Rose Makungu to facilitate the release of his travel documents to enable him to attend to his parliamentary duties. 

His lawyer Gibson Kimani told the court that the lawmaker is scheduled to fly to Dubai with a parliamentary committee.

Senior Principal Magistrate Makungu directed that the court will give its ruling on the application on Monday, August 30, 2021.

During the virtual mention of the case Friday, the defence lawyers notified the court that several pages of the documents evidence provided by investigators are missing.

 

The court took note of this and announced that the case will be mentioned again virtually on October 6, 2021, to confirm the agreement on divulgence of evidence.

The case had been called for a pre-trial conference to confirm whether the state had provided the defence with all witness statements and documentary evidence.

Gachagua was arrested at his Nyeri home on Friday morning, July, 23, by officers drawn from the office of the Directorate of Criminal Investigation (DCI).

The MP is facing six corruption charges on the acquisition of Ksh7.3 billion, which is alleged to be proceeds of crime.

His charges include conspiracy to commit an offence of corruption, fraudulent acquisition of public funds, conflict of interest, money laundering and acquisition of proceeds of crime.
