Sonko Suffers Major Blow in Justice Chitembwe Leaks

Former Nairobi Governor, Mike Sonko, has suffered a major blow in his latest leaks on what he alleged as massive graft in the Judiciary.

The ousted Governor was on Monday, November 22, issued a restraining order barring him from making further accusations and alleged derogatory remarks against High Court Judge, Said Juma Chitembwe and lawyer Cecil Miller. 

The Chief Magistrates Court in Milimani also extended the orders to Amana Said Jirani, Justice Chitembwe's alleged brother, who was accused of colluding with Sonko. 

Lawyer Miller filed the application seeking to restrain Sonko on Friday, November 19, and appeared before Justice H.M. Nyaga, on Monday, November 22, alongside his attorney.

Sonko and his lawyers, however, missed the proceedings which were held virtually.

"It is hereby ordered that the matter is certified as urgent. That pending hearing inter parties the defendants are hereby restrained from publishing further statements/articles forthwith as regards the plaintiffs/applicants.

"That given the nature of the publication and the public interest in the matter this application is to be heard urgently and on-priority basis," the Magistrate ordered.

He also directed the two sides to be served with the application and all the pleadings by Tuesday, November 23. 

The case will be mentioned on Friday, November 26 at 9 am. 

Sonko, while responding to the case, stated that he learned of the restraining order through his security details. 

He took a swipe at Lawyer Miller, who represented him in his impeachment cases in December 2020. Sonko, in his earlier posts, alleged that the attorney betrayed him. Miller has not yet responded to the allegations but opted to use the law courts to tame Sonko. 

“As a law-abiding citizen, who abides by the rule of law, I stand guided and fully comply with the same order safe that I will challenge the same order at the inter-parties hearing,” Sonko tweeted. 

In an interview with KTN News on Wednesday, November 17, Justice Chitembwe claimed that Sonko edited the online videos to frame him. He added that the two were relatives and both grew up in Kwale, hence Sonko’s ease to access him.

"I have known Sonko and his father for years. Sonko's aunt, the elder sister to his mum, was married to my late cousin. Sonko calls me uncle and of course he would come to my place although not frequently," the judge stated.
