Govt Speaks on BBI Ahead of Supreme Court Ruling

Solicitor General, Kennedy Ogeto, has weighed in on the heated debate centred around the Building Bridges Initiative (BBI) ruling that will be delivered by the Supreme Court on Thursday, March 31. 

Speaking in Nyamira County on Wednesday, March 30, Ogeto stated that the government was anticipating any outcome, both positive and negative and that no matter the ruling, justice will prevail. 

Ogeto, an advocate of the High Court of Kenya, addressed the media after launching Nyamira National Treasury and Planning fourth medium-term plan. 

“I cannot tell whether the government will win or lose the BBI case in the Supreme Court.

“All I know is that justice will prevail. We defended our position and it is up to the court to decide,” Ogeto, who works in the office of the Attorney General, Paul Kihara Kariuki, stated.

The Solicitor General represented the AG in the apex court hearing. The AG filed an appeal at the Court led by Chief Justice Martha Koome after the Court of Appeal upheld the High Court's ruling which nullified the BBI. 

Speaking in Nyamira, Ogeto further asked politicians to preach peace ahead of the 2022 General Election. 

“Let us vote in peace, elections come and go,” he urged. 

Those opposing BBI including politicians and activists have castigated the government ahead of the ruling. 

Former Kiambu Governor and Tujibebe Wakenya Party Leader, William Kabogo, however, urged politicians, lawyers and activists to refrain from commenting on the matter since it was active in court. 

“I thought a matter under judicial consideration is prohibited from public discussion elsewhere.

The case is rather still sub judice,” Kabogo urged. 

The BBI appeal hearing at the Supreme Court ended on January 20 after it was heard for three days, from January 18.

All the seven Supreme Court judges, Justices Martha Koome (CJ), Philomena Mwilu (DCJ), Dr. Smokin Wanjala, Njoki Ndungu, Ibrahim Mohammed, Isaac Lenaola and William Ouko will deliver their personal verdict before CJ Koome reads the verdict
