Miguna Hits Back at Matiang'i Over NTV Interview

Exiled Kenyan lawyer Miguna Miguna has slammed Interior Cabinet Secretary Fred Matiang'i over his recent interview touching on his (Miguna's) citizenship.

In a statement he shared on Monday, April 18, Miguna argued that Matiang'i and President Uhuru Kenyatta had repeatedly disobeyed the Court order that allowed him to return to the country.

He further hit out at lawyers who had argued against him claiming that over 15 rulings had been made in his favour.

"To Fred Matiangi and Uhuru Kenyatta: Stop relitigating Justice Chacha Mwita's order in the media. On Dec. 14, 2018, the High Court held that Miguna Miguna never lost his Kenyan citizenship by birth. The Court of Appeal dismissed your appeal. obey Court orders.

"Matiang'i and fellow merchants have made the same incompetent argument about me before multiple High Court and Court of Appeal judges and lost. More than 15 valid court orders have directed them to unconditionally allow me entry into Kenya. I'll not surrender," stated Miguna.

The embattled lawyer further disclosed that he would stop at nothing to ensure that the Kenyan Government obeys the orders allowing his return.

"No matter how long it takes, I will make sure that you obey all court orders and you are brought to account for your contempt of court!

"Make no mistake about it: power is fleeting. In less than four months, you will face the full force of the law. That's a guarantee," he added.

On Sunday, April 17,  Dr Matiang'i, in an interview with NTV's Joe Ageyo, noted that Miguna could regain his citizenship  and travel back to the country after completing a one-page document as prescribed in the country's 2010 Constitution.

The CS added that Miguna had lost his citizenship by virtue of the old constitution which prevented Kenyans from being citizens of more than one country. 

"There are two court rulings on how you can regain it after you lost it in the previous constitution as you were barred from having dual citizenship. When the new constitution was enacted, the process was prescribed in the act on how you can regain it. 

"You have to fill a certain form or piece of paper so that you regain your citizenship back as it were. Since that time over 300,000 Kenyans have regained their citizenship. It's as simple as filling a one-page document," explained the CS.

Matiang'i's statement, however, rubbed some quarters the wrong way with activist Boniface Mwangi accusing the CS and the Head of State of undermining the judiciary by disregarding Court orders.

"Cabinet Secretary Fred Matiang'i was sentenced by our courts for defying and undermining Kenya’s constitution. The Judiciary has issued enough court orders asking the government to ensure Miguna Miguna is allowed back home. Matiang’i and team Uhuru lawbreakers have defied them," argued Mwangi.

Miguna has been exiled in Canada since March 2018 when the State kicked him out over the swearing-in of ODM leader Raila Odinga, then NASA presidential candidate. Odinga took a mock oath as the People's President, vowing not to recognize President Uhuru Kenyatta's legitimacy after contesting 2017 presidential polls and boycotting a repeat election.
