List of Kenyan Lawyers Allowed to Argue Cases at International Criminal Court, ICC

Kenya is notably among countries in Africa that has produced top legal minds, a number of whom are recognised and have been accredited by the International Criminal Court (ICC).

They are Kenya's best legal minds and senior counsels who operate notable and established law firms as well as retired judges.

The number of these layers has skyrocketed and it now stands at 39. According to The Hague-based Court, a lawyer seeking to be accredited by the court must have a high standing in the profession. Kenyans.co.ke did a fact check to identify these top legal minds in the country.



Philip Kipchirchir Murgor

Amos Wako

Amos Wako was one of Kenya's longest serving Attorney General and was the first Busia Senator from 2013 to 2022. He holds a Bachelor of Science degree in Economics from the University of London, a Bachelor of Laws from the University College of Dar es Salaam, and a Master of Laws at the University of London.

He served in several professional organizations, including holding the position of Secretary General of the African Bar Association from 1978 to 1980. He kept his position as Attorney General through the transition from Daniel arap Moi to Mwai Kibaki.

Prof. Githu Muigai

Prof Githu Muigai was Kenya's Attorney General to the year 2019. He was first admitted as an advocate of the High Court of Kenya 1985. He specializes in public procurement law, corporate finance, civil and commercial litigation.

Kennedy Ogeto

Ogeto is the current Solicitor General of Kenya.  Ogeto is an advocate of the High Court of Kenya of over 27 years standing.

Before assuming office as the Solicitor General of the Republic, Ogeto was the Managing Partner of Ogetto Otachi & Company Advocates in Nairobi.

He holds a Bachelor of Laws (LL.B) degree from the University of Nairobi and a Masters in Law degree from the same institution.

Kioko Kilukumi

Kilukumi has represented the President-elect William Ruto at the ICC and presently at the Supreme Court where his August 9 presidential election win is being challenged by Raila Odinga.

Some of the high profile cases Kilukumi has handles are Anglo-leasing scandal and Tokyo Embassy Scandal.

Others lawyers include former Kangema Member of Parliament Muturi Kigano,  National Lands Commission (NLC) chair Gerishom Otachi, Senior Counsel George Oraro, , Katwa Kigen and Evans Monari.

Qualification to ICC 

The Court requires counsel to have experience and relevant expertise in international or criminal law. One must have documents provided by the national bar/ governing authority and a valid copy of professional insurance policy.

The Counsels must also have practiced in the field for a period not less than five years criminal proceedings.

Accreditation Process To ICC

According to the ICC, one must have an original or certified copy of registration with governing body .

Certificate of good standing form and detailed curriculum vitae, allowing for appraisal of the candidate’s competence and experience.

Original or certified copy of the certificate issued by the bar association, professional association and/or the controlling administrative authority with which you are registered.
