Rashid Ahmed: More Woes for Eastleigh Cop as Judge Issues Directive

High Court Judge Kanyi Kimondo on Thursday, January 26, ordered embattled policeman Ahmed Rashid to undergo a medical examination ahead of his plea taking. 

As a legal procedure, Judge Kimondo asked Rashid's Lawyer, Dustan Omari to ensure that his client undertakes the medical test accordingly. 

"Mental examination is a necessary requirement for any suspect charged with murder in a court of law," High Court Judge Kanyi Kimondo ruled. 

However, Omari did not confirm if his client will be available for the medical examination as ordered by the court.

Judge Kimondo also scheduled Rashid's plea-taking for Thursday, February 9, 2023, on a video conference platform as will be provided by the court. 

In a new twist, Omari asked the honourable judge to address an application that he had previously filed to stop his client Rashid from taking a plea. 

"My lord, kindly speak to the matter than we filed seeking a conservatory order on plea-taking by my client," Omari implored the Judge.

In response, Judge Kimondo told Omari that his motion neither had a return nor a hearing date, but promised to settle the matter later in the coming week. 

Meanwhile, Judge Kimondo affirmed his order, noting that Rashid should be escorted by police officers from Garissa to Nairobi for a mental assessment. 

"If the suspect voluntarily surrenders to the police for mental assessment, the Officer Commanding Police Station should be at liberty to release him a bond," the judge clarified. 

Rashid was attached to Pangani Police Station, and served in the position of a Sergeant in the dreaded crack unit that was accused of extra-judicial killings in Eastleigh, Pangani and Mathare slums without any consequences.

In particular, Rashid is accused of killing two unarmed suspects when they were fatally shot on March 31, 2017, on suspicion of engaging in crime within the Eastleigh neighbourhood.

On Thursday, November 24, 2022, the Independent Policing Oversight Authority (IPOA) chairperson Anne Makori, noted that Rashid would be charged with the murder of two of his suspected victims Jamal Mohamed and Mohamed Dhair Kheri.
