Linturi Wins Round 2 in Keitany's Battle for Ksh 100M Runda Mansion

The court, on March 16, ordered police officers at Runda Police Station to evict Aldai Member of Parliament Marianne Keitany from her ex-husband, Agriculture CS Mithika Linturi's, Runda mansion. 

Chief Magistrate Wendy Michemi lifted an order that stopped Bealine Auctioneers from evicting Keitany from the house, a caveat placed after the MP appealed her ejection. 

The order given on February 15 had offered Keitany a lifeline as she sought to bar Linturi from kicking him out of the house. 

On February 13,  Nairobi Milimani Commercial Court allowed auctioneers to evict Keitany before she got a stay order two days later.

According to the court, CS Linturi was the legal owner of the contested Ksh100 million house. 

“Her (Marianne Keitany) application challenging the eviction is hereby dismissed.

"The officer commanding Runda Police Station and, in his absence, any other police officer above the rank of assistant inspector of police is ordered to provide security and police officers to assist in evicting her from the house,” Chief Magistrate Wendy Michemi ruled. 

In August 2022, Keitany lost the first case in a bid to retain the palatial Runda home. The court ruled in favour of Agriculture CS, Mithika Linturi. 

"As the applicant has to establish both the arguability and the nugatory aspects, the applicant has failed to establish the twin limbs for consideration in an application. The upshot is that the application dated February 10, 2022, is without merit and is hereby, dismissed with costs," the three-judge bench comprising judges, Mbogholi Msagha, Hannah Okwengu, and Jamilla Mohammed ruled. 

Linturi and Keitany's high-profile court drama has riveted the nation since 2019.

On August 28, 2019, Keitany gave a court testimony aimed at proving that she had a customary marriage with Linturi. 

The MP provided pictures and poems depicting the couple’s good times. She even reproduced a poem allegedly drafted by Linturi. The poem, in part, read;

She even showed pictures of Linturi introducing her to crowds during campaigns. The CS countered by stating that he had been married to one Mercy Kaimenyi since 2000.

In 2022, a magistrate court ruled that Linturi and Keitany were not married as the customary marriage, done in 2016, was not registered lawfully.

The magistrate noted that the Marriage Act of 2014 demanded the registration of a customary marriage.

Keitany losing back-to-back cases concerning the house in Runda and the suit concerning the legality of their marriage is the latest in the four-year dispute.
