UDA Speaks Out on Nimrod Mbai's Fate

The United Democratic Alliance (UDA) on Wednesday, July 5, confirmed that it was keenly following a case involving its member, Kitui East MP Nimrod Mbai, accused of assaulting a Kenya Power staff member.

Speaking to Kenyans.co.ke, a source privy to the matter noted that the incident is a criminal case that was being handled by the police. 

He added that the party's action would align with the findings of the Directorate of Criminal Investigations (DCI) upon the completion of investigations. 

"As of now, the matter is a criminal case. We are monitoring to see how it goes," the source, who spoke on condition of anonymity, stated.

Efforts by Kenyans.co.ke to reach UDA Secretary-General Cleophas Malala were futile because he did not respond to our calls and texts. 

Possible Outcome

If the MP is found at fault by the Police, UDA can summon the him to appear before the disciplinary committee over his conduct. 

The committee then gives recommendations on the disciplinary measures befitting the accused after the meeting. 

Earlier, DCI officers confiscated Mbai's firearm after the lawmaker accompanied the detectives to his Kitengela-based home.

According to section 114 of the Firearms Act, a court may, on the application of a police officer, customs officer, or licensing officer, order any firearm or ammunition seized and detained under this Act to be destroyed or otherwise disposed of.

On Wednesday morning, Mbai was arraigned before Kajiado Law Courts where he failed to take a plea hence the case was referred to the office of the Director of Public Prosecution (ODPP).

Kenya Power Managing Director Joseph Siror condemned Mbai's actions and explained that the assaulted employee was on routine surveillance of the power network to ensure that it was free from illegal activities.

“While working to weed the network of illegal and dangerous connections, we regrettably note an emerging trend of violent attacks against our staff. The latest of these incidents happened on Monday, July 3, in Kitengela where our staff were attacked by the Kitui East Member of Parliament, Nimrod Mbai," he remarked.

The Kenya Power boss appealed to security agencies to protect them while in the line of duty.

“We have taken up this issue with the relevant authorities and the matter is now before the courts. As an entity that prioritizes the welfare of its staff and the public, we condemn this incident and we wish to categorically state that we do not condone any form of violence, at least not on our staff while on official duty,’ he added.

In a viral video on Tuesday, July 4, the MP was captured assaulting a Kenya Power technician to the point of trying to pull out his gun in a fit of rage.

24 hours later, the MP surrendered himself at Kitengela Police station.
