'Mathe Wa Ngara' in Court to Block Her Arrest

Businesslady Nancy Kigunzu has moved to court to block her arrest, claiming that she is a law-abiding Kenyan with a legitimate source of income.

Alias Mathe Wa Ngara, Kigunzu has been on the news over the past week after detectives busted drugs and about Ksh13.4 million in cash believed to be proceeds from drugs.

During the raid, police arrested a woman Teresia Wanjiru who later turned out to be the wrong person, putting police on the spot.

Kigunzu has said in court papers that she is being pushed out of her legitimate business on fake charges and that police are using her as a scapegoat.

"The applicant is of the firm belief that the timing of the arrest is designed to intimidate and ensure that she does not continue running her business here in Kenya," Kigunzu stated in her application.

She has asked the court to issue an injunction pending a request for anticipatory bail. Anticipatory bail is issued to block the possible arrest of a suspect. 

Media reports on Sunday claimed that the woman called Wanjiru who was mistakenly arrested to apologise even as police mounted a manhunt.

Wanjiru was set to be arraigned in court on Monday, August 21 for a hearing. The Directorate of Criminal Investigations (DCI) however sought to further detain her for five more days.

Kigunzu has detailed in her application that she will present herself to the police if guaranteed a fair and just legal proceeding.

"The powers of arrest by the 1st (DCI) and 2nd (IG Koome) respondents are being abused and misused to harass, intimidate and oppress the applicant," the woman said in the application.

The police have accused the woman of being part of a drug ring that was busted last week as law enforcement officers crackdown on drug traffickers across the county.

The raid netted bhang and counterfeit cigarettes besides loads of cash stashed in sacks in Ngara.
