The Kenya African National Union (KANU) Executive Director George Wainaina has committed to settling a debt of Ksh22 million within 60 days.
The legal team representing the politician, while appearing before Justice Josephine Mongare, noted that they were ready to settle the money in the duration for Wainaina to avoid a civil jail term.
In an audio obtained by Kenyans.co.ke, the petitioner lamented that the politician, who is a former chief of staff at Nairobi County Government, had defaulted on an agreement the two parties entered in March 2022.
"They made some payments dating back to March 2022. They have not complied. They were to pay Ksh22,265,000 and have not paid even a single cent," observed the lawyer.
Wainaina's legal counsel, however, confirmed that a fresh agreement allowing their client to settle the debt in 60 days was entered on Monday morning.
"My Lady, we have not complied but we did speak with the counsel this morning and agreed that we record a consent in the following terms. We agreed that owing to the fact that we want to settle the matter amicably, we will pay within the next 60 days and in default then execution to issue," the defendant responded.
The petitioner, however, admitted that he assented to the agreement reluctantly to avoid acrimony and dealings of bad faith.
"I reluctantly accepted because we have come through mediation and I don't want us to imbibe bad faith and acrimony in this matter," the complainant explained indicating that the two-month period would be the last chance accorded to the politician.
The first ultimatum in the case was issued in March 2022 at a time when Wainaina was directed to pay the complainant Ksh113 million in a span of four months, between March and May that year.
At the time, the defendant was expected to deposit Ksh30 million immediately and monthly installments of Ksh20 million.
The warrant of arrest issued against the politician was subsequently suspended to allow him to comply with the directive.
Reports at the time indicated that the defendant embarked on selling his properties including nine parcels of land to offset the debt.
