Sabina Chege Loses Parliament Position as Jubilee Court Battle Rages

Nominated Member of Parliament Sabina Chege on Monday lost her position as the Deputy Minority Whip in the National Assembly. 

A case filed by Chege in a Kiambu Court to challenge Azimio la Umoja's decision to remove her from the position was thrown out on Monday. 

Consequently, Embakasi West MP Mark Muriithi Mwenje is set to be the new Depurity Minority Whip in the 13th Parliament.

"We now demand that the Speaker, Moses Wetangula ratifies the decision to allow Hon. Mark Mwenje to serve," a statement by Jubilee Party read in part.

Jubilee Party has been in a protracted legal battle over leadership, with the Chege-led faction fighting the Uhuru-led wing to control the party and millions in the kitty. 

Former President Uhuru Kenyatta has indicated that he would not quit the party, maintaining his allies in key positions after the fallout with Chege and Kanini Kega group, who have since moved to work with Kenya Kwanza. 

Azimio had unsuccessfully tried to replace Chege on May 4, but Wetangula stopped the move ruling that the coalition had not furnished the House with a replacement. 

"The communication received from the Minority Party on the decision to oust Sabina Chege is incomplete and therefore does not comply with the requirements of Standing Order 20(A) of the National Assembly," Wetangula ruled then. 

Azimio subsequently nominated the Embakasi West MP but Chege through her lawyer Dennis Kivuti moved to court to object to her ouster. 

"Pending hearing and determination of the case, the Honorable Court be pleased to issue such further or other order(s) as it may deem just and expedient for the end of justice," the court ruled in June 

Following that ruling, Speaker Wetangula stated that Chege would continue executing her duties until the courts pronounced itself on the matter. 

"Honourable members from the foregoing, my hands are tied with regard to the court order that has been brought to my attention," he stated then.
