A 48-year-old old man who was charged with defiling his 12-year-old daughter has been sentenced to 20 years in prison by a Court In Lamu.
The Director of Public Prosecutions (DPP) on Wednesday revealed that the man defiled his daughter severally on diverse dates between 2020 and August 26, 2022, in Ndeu Village, Lamu County.
While delivering his ruling, Lamu Principal Magistrate Martin Wachira noted that he had arrived at the decision after examining the evidence presented before him.
''The prosecution, through Prosecution Counsel Rosemary Karanja, presented five witnesses to prove its case and guide the court in convicting and sentencing the accused,'' the ODPP noted in its statement.
According to the ODPP's account, the father took advantage of his daughter after her grandmother, with whom she lived, sent her to the father's house to pick up various food items.
The daughter started living with the grandmother after her parents separated.
However, her grandmother later died, leaving the minor under the care of her aunt. It was at this point that she opened up on what happened to her after which, the case was forwarded to the authorities.
''The aunt took her to the Mpeketoni Sub-county children's office, which referred the matter to area police before it was transferred to the Hindi police station, where the incident occurred,'' further noted the ODPP.
ODPP stated that the minor incurred severe mental trauma and psychological effects which might be long term.
In the recent past, several men have been convicted of defiling minors.
On July 28, 2023, a Nairobi court convicted a pastor after finding him guilty of defiling a boy aged 11, and his sister 14, on diverse dates 9 years ago.
Principal Magistrate CM Njagi, while convicting the accused observed that the prosecution had proved the case beyond reasonable doubt.
