Compliance Guidelines Costs Bidders Ksh60,000 Each in KeNHA Auction

The Kenya National Highways Authority (KeNHA) has revoked bids tabled by members of the public for failing to comply with the outlined requirements and bidding process regulations. 

In a notice released on Tuesday, February 20, the authority stated that the bidders, despite being granted an opportunity to assess the items on offer, and their published reserve prices within the allowed guidelines, acted to the contrary. 

“It has come to the attention of the authority that some members of the public frustrated the auction of select items in the just concluded auction process,” the notice read in part. 

KeNHA further announced that the items bid for by the prospective buyers will be processed and auctioned afresh at a later date.

“The authority read mischief in the select bidder's offer since they have not honoured their bids,” KeNHA stated. 

“In compliance with the Public Procurement and Assets Disposal Regulations (PPADR), the said bidders will lose their auction deposit of Ksh60,000.” 

In their previous auction announcement, interested bidders were required to pay a refundable fee of Ksh60,000 per vehicle and Ksh50,000 for weighbridge scrap. 

Defending its reason for changing the bidding fees requirement to non-refundable, KeNHA cited the need to comply with regulations and procedures put in place for the auction processes. 

“The Authority commits to promoting accountability and efficiency in public procurement, ultimately serving the interest of the citizens and the public good,” KeNHA affirmed. 

The auction, which was organised on February 7 in Athi River, involved the resale of several items including motor vehicles, which had been inspected and valued by the Mechanical and Transport division, under the Ministry of Transport. 

Other auctions took place at Isinya, Juja, the Ministry of Roads Building Makaburini Road in Nyeri Town for Mt Kenya residents and Mahindi Road off Shimanzi Road for the coastal region. 

The South Rift auction took place at the Provincial Works Building along Prison Road in Nakuru, while the Western Region was served from the Ministry of Roads Building along Kisumu-Kakamega Road.
