President William Ruto’s lawyer, Katwa Kigen, faced a setback on Tuesday as a court declined to halt the impeachment motion against Kisii Deputy Governor Dr. Robert Monda.

Kigen, who represents the Deputy Governor, had sought to block the Kisii County Assembly from expediting the motion.

"I, Katwa Kigen, do certify that the application is of utmost urgency as the petitioner is at the peril of irreparable injury of being subjected to a process of impeachment," read the court documents

However, the judge declined to grant the barring of the case explaining that the Monda would not suffer any prejudice in the event that the motion proceeded into hearing.

While filing the application, the lawyer had proceeded to note that if the County Assembly proceeded with the motion the Deputy Governor would miss out on his constitutional rights to the hearing of a fair trial.

However, despite the application, the judge stated that “ No prejudice would be occasioned if this court doesn't grant interim orders at this stage.

“I am not inclined to grant the interim orders at this stage and I say no more, as it may prejudice the outcome of the proceedings herein,” noted the judge.

Consequently, the Deputy Governor is expected to appear before the Kisii County Assembly for the impeachment case hearing within the week.

Previous developments regarding the case expose a growing discord within the Kisii County Government, with Members of the County Assembly (MCAs) divided over Monda's impeachment.

During a House session, the MCAs were engaged in a brawl after the Speaker of the Assembly referred the motion.

The MCAs led by the Ichuni Ward MCA Wyclife Siocha, disputed the referring while the other section supported the speakers’s move.

Dr. Monda is accused of alleged abuse of office claims and violation of the constitution within his capacity, allegations which the deputy governor has denied.
