Ruto Appoints 7-Member Tribunal to Probe Suspended Judge Kullow’s Case

President William has appointed a 7-member tribunal to investigate Environment and Land Judge Mohammed Kullow.

In a gazette notice published on Friday, March 8, 2024, Ruto suspended the judge, as recommended by the Judiciary Service Commission (JSC).

The team, led by Judge Patrick Omwenga, will probe into the conduct of the High Court Judge, following five petitions filed for his removal.

According to the petitions filed, Kullow delayed and failed to deliver on 116 cases during his tenure in Narok.

The tribunal members include Lady Justice Margaret Njoki Mwangi, Justice Anthony Charo Mrima, Jinaro Kipkemoi Kibet and Wanjiru Mwariri. 

Others are Rukia Abdinassir Mohamed and Charles Mulila, with the lead counsel Dorcas Agik Oduor, and Jasper Mbuki and Collins Kiprono as joint secretaries. 

The Judicial Service Commission (JSC) on Wednesday, March 6, announced plans to remove Justice Mohammed Kullow from office after five petitions were filed before the commission.

The commission noted that the Judge violated the Constitutional and Judicial Service Code of Conduct. 

According to a statement from the Chief Justice Martha Koome-led Commission, the removal process was initiated on grounds of gross misconduct, incompetence and violation of the Judicial Service Code of Conduct according to three of the petitions. 

The other two petitions claimed that the Kullow failed to meet the threshold, citing 116 cases that were still pending. 

“In addition, upon receipt of several complaints, the JSC on 31st May 2023 resolved on its motion, to initiate proceedings for the removal of Justice Kullow from office, for inordinately delaying or failing to deliver rulings or judgements in a total of 116 matters,” the JSC statement read in part. 

“The Commission has Petitioned His Excellency the President, William Ruto, to appoint a tribunal in accordance with the Constitution," JSC had recommended.
