Court Acquits Moses Kuria and Ferdinand Waititu in Hate speech Case

Gatundu South MP Moses Kuria and his Kabete counterpart Ferdinand Waititu on Monday won a court fight in which they were accused of making inflammatory remarks.

Kuria was taken to court last year after allegedly calling for the assassination of CORD leader Raila Odinga while Waititu was accused of making statements that could propagate violence in the country.

The duo was at a night meeting in Kasarani Stadium last year when they uttered the statements which led to their incarceration at Pangani Police Station.

Presiding over the case, Nairobi Magistrate Charity Oluoch, stated that the English and Kiswahili translations provided as part of the evidence in the case were incorrect.

Ms Oluoch further cast doubt on the video presented as evidence highlighting that it could have been altered.

During the June 2016 meeting, the Kuria was caught on tape alluding that Mr Odinga should be taken out as he was not "threat to the nation" and should not be allowed to trouble the country forever.

On the other hand, Waititu threatened that they could take unspecified action on CORD supporters who would dare throw stones during protests in Nairobi.

The two, who were speaking in Kikuyu, caused panic in the country forcing ODM leaders to respond to the remarks in the same measure.

The legislators were arrested alongside four other male MPs and monikered Pangani six.

They included; Machakos Senator Johnstone Muthama, Suna East MP Junet Mohamed, Timothy Bosire of Kitutu Masaba, Kimani Ngunjiri of Bahati, and woman representatives Aisha Jumwa and Florence Mutua of Kilifi and Busia respectively.
