Court Orders Police Not to Arrest Millie Odhiambo

The High Court on Tuesday barred police office from arresting Mbita MP Millie Odhiambo over remarks she made against President Uhuru Kenyatta.

High Court Judge Luka Kimaru directed that the police stay off the legislator and allow for investigations to continue.

Judge Kimaru further ordered Ms Odhiambo to present herself at the Parliament Police Station on January 12 at 10 am to help the police with their investigations.

The CORD MP run into trouble during the National Assembly's first Special sitting to debate the controversial Election Laws.

Together with other Opposition leaders, Ms Odhiambo caused drama at the Parliament buildings by blocking Speaker Justin Muturi from leaving his chambers.

While addressing the press, the Mbita MP hurled abusive words at President Kenyatta and boldly told him to take her to court.

She further told the President that she does not respect him and that he would be sent back to Gatundu in the 2017 poll.

Odhiambo was sued by activist Philip Njuguna, who argued that the MP ought not to be protected by Parliamentary Immunity and Privileges since her utterances amounted to belittling the Presidency, which is a Constitutional institution.

"Her utterances are in contravention of the constitution as they constitute denigrating the Presidency. The words uttered have by extension violated the Parliamentary privilege and immunity and such is not available to her defence," Njuguna cited in court documents.
