Kenyan Judge Vetted Even After Resignation

High Court judge Nicholas Ombija was on Thursday vetted in absentia despite taking an early retirement on Tuesday to avoid the process.

Justice Ombija was scrutinized by the Judges and Magistrates’ Vetting Board chaired by Sharad Rao, which reportedly found him unfit to continue serving in the judiciary. 

Following his resignation, the Board emphatically stated that Justice Ombija's grilling would still continue.

“Judge Nicholas Ombija of the High Court will still be vetted despite tendering his resignation," the board declared.

Ombija had failed to stop the board from probing him after fresh allegations were raised against him, faulting his conduct as a Judge.

In 2012, the vetting panel recommended his dismissal citing defects in the judge's temperament, a decision Ombija challeged at the High court. 

After losing the case at the Milimani Law Courts, Justice Ombija carried the matter to the Court of Appeal which ruled in his favour, hence, continued discharging his duties.

The Vetting Board then appealed the ruling, taking the matter to the Supreme Court, which directed for fresh grilling of Justice Ombija.

Ombija is remembered to have made a hallmark ruling that directed for the arrest of Sudanese President Omar al-Bashir and subsequent handover handed over to the International Criminal Court (ICC), when the latter visited the country in 2011.
