Mark Too Burial Stopped by Court

Retired President Daniel Moi's confidant and veteran politician, Mark Too's burial has been halted following a court order.

The directive issued by High Court Judge Aggrey Muchelule was made following an application by one of his wives identified as Fatuma Ramadhan Hassan.

According to Fatuma, the wealthy politician had sired a son with her but her co-wives had left them out in the burial arrangements.

Through her lawyer Danstan Omari Mogaka, the woman demanded that her 16-year old son be given an inheritance of his father's property.

Fatuma indicated that her two co-wives - Mary Too and Sofi Too - were blocking her son from taking part in the burial of Mr Too. She sued her co-wives and the Lee Funeral home demanding Too's body remain at the mortuary until the case is heard.

"The respondents (Sofi and Mary) have been spearheading the funeral and burial arrangements of the deceased to the exclusion of the minor. Excluding the minor from participating in his father's final sendoff amounts to discrimination and such acts should be frowned upon as it is against the Constitution," Fatuma said.

She added, "the deceased refused and neglected his parental responsibilities and I was forced to file a child support case in 2011 in order to obtain court orders compelling him to maintain and discharge his parental responsibilities."

The former nominated MP died on December 31, 2016 after he was rushed to St. Luke’s Hospital in Eldoret for treatment.

Though autopsy results revealed that Too succumbed to a heart problem, unverified reports stated that he could have been killed by political rivals.

The case will be heard on Friday while the late politician is expected to be buried on Monday.
