Machakos Senator Johnson Muthama has been summoned to appear before the court on October 15 over allegations of incitement to violence.
This comes after the High court on Thursday, declined to approve his application to stop his arrest and prosecution that was instructed by the Director of Public Prosecutions Keriako Tobiko.
In his plea, Muthama stated that the move to prosecute and arrest him was in violation of the constitution terming it selective, punitive and discriminatory.
Tobiko on Monday approved charges against the Senator over alleged hateful utterances he made during CORD's solidarity rally at Uhuru Park.
The DPP said that there was sufficient evidence to sustain the charges of incitement against Muthama and directed for his prosecution.

Muthama is facing the charges alongside CORD activist Japheth Muriira Muroko for comments made on September 23 that were injurious and against Section 96(A) of the Penal Code.
The Senator also faces charges over utterances he made against President Uhuru Kenyatta when he insinuated that the President had more than just a working relationship with Cabinet Secretary Anne Waiguru.
