State Appeals Against High Court Decision to Suspend Prosecution of Mombasa Governor Ali Hassan Joho

The State has appealed a decision of the High Court to halt the prosecution of Mombasa Governor Ali Hassan Joho over credentials of his academic certificate.

The Director of Public Prosecution (DPP) moved to the Court following the ruling issued in April which gave a lifeline to the Governor.

Last month, Judge Eric Ogola ruled in favour of Mr Joho barring the police and the DPP from arresting and prosecuting Joho.

Kenya Revenue Authority (KRA) had also accused the Mombasa boss of tax evasion hence prompting the state to appeal against the decision of the High Court.

Justice Ogola, in the earlier ruling, termed as malicious the actions taken by KRA and other state agencies against Governor Joho.

He observed that the bodies had misinterpreted President Uhuru Kenyatta's political utterances during his Mombasa visit as a call to harass the ODM deputy leader.

"Why the flurry of investigations and why now? The respondents misinterpreted the President’s utterances," he observed.

The High Court judge added that the state intended to destroy the Governor's political career, especially his bid to vie in the August 8 General Election.
