Two women at Machakos Level 5 hospital who gave birth on the same day are fighting over an infant.
The two delivered within minutes of each other to children who had breathing complications.
One of the children died hours after delivery but both women refuse to accept that it was their child.
The hospital's administration claims that the babies had been placed at the new born unit for monitoring before one of them died.
Machakos Health County Executive Naomi Mutie, says the babies had been tagged with their mothers name.
She said that one of the mother's whose baby had died could not accept that her child had passed on.
The family of one of the mothers identified as Njeri, however, insist that a mix up had occured.
Speaking to NTV, Njeri's mother said that the other woman had been given Njeri's child.
Njers's family said they could not afford a pathologist to do a DNA test or a lawyer to challenge the hospitals decision to give away their child.
